Terms of Service

1. About these terms

These Terms of Service govern your use of nexxtnestgroup.com.au and the SIYA service provided by Nexxt Nest Group. By using our website or our service, you agree to these terms.

2. The Service

SIYA monitors a client's nominated channels — including phone calls, Facebook and Instagram comments and messages, and reviews — to identify buying signals, score leads, and prepare draft replies and follow-up recommendations for the client's review.

SIYA recommends — the client decides. No message is sent and no action is taken without the client's approval, except where expressly agreed in a service agreement.

3. Enquiries and the Free Growth Audit

Submitting our enquiry form or requesting a Free Growth Audit is not a binding contract — it is an invitation to discuss whether SIYA is a fit for your business. A binding engagement begins only once both parties agree to a separate service agreement or order confirming scope, pricing and term.

4. Client responsibilities

As a client, you agree to:

• provide accurate information about your business and the channels you connect to SIYA
• hold any rights, consents and permissions needed for us to access those channels (for example, Facebook and Instagram page permissions)
• review and approve SIYA's prepared responses before they are sent, where sending has not already been pre-agreed

5. Fees and payment

Fees are set out in your service agreement or order. [Insert standard payment terms — invoicing cycle, late payment, refund policy.]

6. Intellectual property

The website, the SIYA name and branding, and the underlying software and methodology remain the property of Nexxt Nest Group. Nothing in these terms transfers ownership of that intellectual property to you.

7. No guaranteed outcomes

We do not guarantee specific results, including lead volumes, conversion rates or revenue. Outcomes depend on factors outside our control, including your industry, market conditions and how quickly you act on SIYA's recommendations.

8. Limitation of liability

To the maximum extent permitted by law, our total liability arising from or in connection with the service is limited to the fees you paid in the preceding three months. Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded.

9. Termination

Either party may terminate the service in line with the notice period set out in the service agreement. [Insert standard notice period.]

10. Governing law

These terms are governed by the laws of Victoria, Australia, and the parties submit to the non-exclusive jurisdiction of its courts.
